IV- Ability To Assume The Obligations Of Membership




1- FREE MOVEMENT OF GOODS

Laws relating to Free Movement of Goods which have been adopted since the publication of the Council Decision of 8 March 2001 on the Accession Partnership with the Republic of Turkey are stated below and other national legislation is listed in Annex 1.

II- MEASURES FOR HARMONISATION WITH THE EU LEGISLATION AND IMPLEMENTATION

PRIORITY 1.1 New Approach Directives
1- Priority Description
Turkey assumed the obligation of harmonization of technical legislation regarding the safety of products through Association Council Decision 1/95. The New Approach Directives substitute an important part of the legislation with 20 directives, and 16 of them have already been harmonized
For the proper implementation of the directives it is essential to establish a market surveillance and conformity assessment system, and develop the accreditation, certification and testing bodies and laboratories which will operate within this system in conformity with European Union requirements. To this end, a project has been prepared within the framework of the 2003 Programming of Turkey –EU Pre-Accession Financial Assistance to improve the physical infrastructure for market surveillance and conformity assessment regarding machines, electrical equipment, pressure equipment, toys, medical devices and telecommunication terminal equipment. As regards other products, technical assistance from the EU Commission has been requested in order to provide assistance for necessary inventory works for project preparation.
For the New Approach Directives, the short term targets are;
- Complete alignment with the acquis,
- Establishment of market surveillance and conformity assessment system and their implementation.
In the middle term it is envisaged to,
- Complete necessary infrastructure, and full enforcement of the system
The Communiqué on Basic Principles for Assignment of Notified Bodies Concerning Recreational Crafts, has been prepared within the Framework of the Implementing Regulation on Recreational Crafts harmonizing Council Directive 94/25/EC (see Annex 1.1), and published in the Official Gazette No 25066 on 11 April 2003. The envisaged financial requirements in this respect will be defined later.

a) For the full implementation of the Implementing Regulation a transition period is foreseen, for this reason “the expected date of entry into force” for this measure has been established thus.
b) The Implementing Regulation on Radio and Telecommunication Terminal Equipment (R&TTE) was published in the Official Gazette No.25105, on 11 May 2003. These Implementing Regulations will regulate the working principles and procedures for market surveillance and notified bodies concerning R&TTE .
c) The Implementing Regulation on Construction Products has been published in Official Gazette No 24870, on 8 September 2002. The mentioned Implementing Regulations will regulate the working procedures and principles for market surveillance and notified bodies concerning Construction Products. Moreover, with the amendments mentioned above, the architects and engineers of construction control bodies will be assigned as controllers on construction sites for market surveillance. Construction legislation regarding the essential requirements will be included in the market surveillance and control of construction products.

The Ministry of Industry and Trade will improve 3 executive Directorate Generals (Directorate General for Industry, Directorate General for Measurements and Standards, and Directorate General for Protection of Consumers and Competition) and provide pilot Province Directorates with necessary equipment and qualified personnel 2003-2006

PRIORITY 1.2 Motor Vehicles and Agriculture or Forestry Tractors
1- Priority Description
In the field of Motor Vehicles and Agricultural and Forestry Tractors, 91 of 97 of the directives have been harmonized and have entered into force. Within the framework of motor vehicles legislation, national type approval certificate is granted to vehicles after being tested and examined by the Technical Services assigned by the Ministry of Industry and Trade. As the technical legislation regarding motor vehicles enters into force, the Ministry is seeking ‘e’ mark for the components, systems, or separate technical units that will be fitted to vehicles. Following the harmonization of all legislation on Motor vehicles, type approval for the whole vehicle will be granted.

Turkey has signed the UN/ECE (United Nations Economic Commission for Europe) Geneva Agreement “Concerning The Adoption of Uniform Technical Prescriptions For Wheeled Vehicles, Equipment and Parts Which can be fitted and/or be used on Wheeled Vehicles And The Conditions For Reciprocal Recognition of Approvals Granted on The Basis of These Prescriptions”. The accession was ratified with the Decision of Council of Ministers No. 96/8657 which was published in the Official Gazette No 22868, on 5 January 1997. The Implementing Regulation Relating to Implementation of Technical Legislation Concerning Wheeled Vehicles, Equipment and Parts which can be fitted and/or be Used on Wheeled Vehicles was published in the Official Gazette No. 22874, on 11 January 1997. This legislation was issued for the implementation of the technical principles and for the adoption of UN/ECE Regulations issued under the Agreement. Until now, The Ministry has published 102 Regulations out of 113 in the Official Gazette and notified these to the Economic Commission for Europe. The ‘E’ mark issued according to UN/ECE Vehicle Regulations is actually equivalent to the ‘e’ mark granted within the framework of EU Directives, accordingly, the components produced according to the provisions of UN/ECE Regulations are in free distribution among EU countries and other countries that are parties to this Agreement.
In addition, for the improvement of testing and certification infrastructure for motor vehicles, a project to the value of 3 million Euros has been approved in the 2002 Programming of Turkey –EU Pre-Accession Financial Assistance, and the necessary procedures for this project are envisaged to start in 2003.

PRIORITY 1.3 Foodstuffs
1- Priority Description
Food control in Turkey is carried out by the Ministry of Agricultural and Rural Affairs and the Ministry of Health. Alignment with EU criteria in food safety can only be realised by the adoption of the relevant EU legislation and implementation thereof. The physical infrastructure of control laboratories have to be improved to ensure the correspondence between harmonisation of the relevant legislation and its implementation. Moreover, a “Rapid Alarm System” has to be established to ensure nationwide food safety.
A project has been prepared to improve the physical infrastructure of the relevant ministries and to establish a rapid alert system between local organizations of the related Ministries and central units. For the final approval of the project, “Food Safety Coordination Unit” has to be established through the contributions of the two Ministries.
Concerning food safety, following measures are foreseen in the short term;
- Completing all necessary legislative alignment,
- Establishment of Food Safety Coordination Unit,
- Strengthening the necessary infrastructure for food control.

PRIORITY 1.4 Chemical Substances
1- Priority Description
Task 1.4.1 Chemicals
The existing Implementing Regulation on Dangerous Chemical Substances About Chemical Substances and Preparations will be revised and related communiqués will be promulgated. With these measures almost all of the EU legislation will be harmonized in this field. However during the revision of existing regulation, an inventory has to be prepared for new chemicals definitions and a network has to be established in order to add additional provisions.
For the inspection of chemical substances the administrative structure has to be reorganized according to the needs of the new system. Moreover for proper monitoring and verification during the implementation, Good Laboratory Practices (GLP) principles have to be established and the related administrative structure has to be reorganized accordingly.
In the framework of Chemicals short term target is;
- Completing inventories and to establish a national inventory database,
Middle Term targets are,
- Ensuring a complete alignment with the acquis and strengthening the administrative structure,
- Establishment of a system for inspection of chemical substances and preparations, and strengthening the administrative structure
- Preparing necessary administrative structure for monitoring and verification activities according to the GLP principles.
Task 1.4.2 Detergents
Draft legislation amending the Regulation on Special Characteristics of Material and Equipment concerning Foodstuffs and Public Health is expected to enter into force. This draft aims to change the existing pre-authorisation system in order to establish a notification and market surveillance system for detergents. Subject to the enforcement of the draft, it is planned to issue a Communiqué relating to Biodegradability of Anionic, Nonionic, Ampholitic-Amphoteric and Cationic Surfactants in Detergents and Notification on Test Methods of Biodegradability of Anionic and Nonionic Surfactants and strengthen the technical and administrative structure in line with the provisions of the Communiqué.
Assistance will be provided by the project proposed to the 2003 Programming of Turkey –EU Pre-Accession Financial Assistance. The project aims at the improvement of the necessary infrastructure for the effective inception of implementation.
Task 1.4.3 Fertilizers
Turkish legislation harmonised with EU legislation on fertilizers entered into force in 2002. However, because of the inadequacy of analysis laboratories in terms of physical infrastructure, an efficient technical implementation cannot be performed. In this regard, it is foreseen to propose a project to the 2004 Programming of Turkey –EU Pre-Accession Financial Assistance.
Task 1.4.4 Psychotropic Substances
It is planned to complete the alignment with the legislation concerning Psychotropic Substances in the short term. Moreover, Turkey has close cooperation with EC Commission on traffic and use of these substances.
Task 1.4.5. Good Laboratory Practices
Full alignment with Good Laboratory Practices on chemicals, detergents, foodstuffs and medicinal products parallel to EU practices is planned..

PRIORITY 1.7 Cosmetics
1-Priority Description
With the Draft Law on Cosmetics, it is foreseen to ensure safety in cosmetics products and provide effective market control by establishing a registration system for new products, as well as harmonising with the EU legislation.
With the administrative measures subject to the Draft Law, the following short term measures are envisaged:
- Defining the substances that may be used in the production of cosmetics,
- Establishment of the necessary infrastructure for the market control system
.

PRIORITY 1.10 Horizontal and Procedural Measures
1-Priority Description
Task 1.10.1 Accreditation
Turkish Accreditation Authority (TURKAK) was established on 4 November 1999 with Law No. 4457. The main objective of TURKAK is qualifying and widening the conformity assessment services during the period of EU candidature.
TURKAK is the responsible institution for the accreditation of the relevant national or international bodies, which are involved in laboratory, certification and inspection services. TURKAK is also responsible for the recognition of product/service, system, personnel and laboratory certificates in the international area to ensure that these bodies are operating to national and international standards.
TURKAK started to accept accreditation applications in June 2001, after the preparation of its working documents. As of February 2003, 32 applications had been received and the accreditation certificates have been issued in five cases, after the completion of the necessary auditing work. All of this work was carried out according to the principles of impartiality and independence as required by ISO/IEC 17011 Standard, which must be fulfilled by the accreditation institutes.
The international recognition of TURKAK’s activities is crucial for Turkish industry. Accordingly, from the date of its establishment TURKAK management and personnel have fulfilled the provisions arising from ISO/IEC 17011 Standards. As a result, TURKAK’s full membership was accepted after assessment and voting in the meeting of the General Assembly of European Co-operation for Accreditation (EA), held in Copenhagen, Denmark on 27 November, 2002. TURKAK was also granted associate member status of the International Laboratory Accreditation Cooperation (ILAC) in 2002.
Task 1.10.2. Metrology and Pre-packaging
There are 25 directives in this field and all of them were harmonised by the Ministry of Industry and Trade. The Ministry will also start market surveillance of the products that are subject to the legislation harmonising Council Directive 90/384/EEC. This Directive, which is also one of the new approach directives, concerns Non-Automatic Weighing Instruments.
Task 1.10.3. Standardisation
The Turkish Standards Institution (TSE) was established by Law No.132 (published in the Official Gazette on 18 November 1960). It is a legal entity and managed according to the provisions of private law. The Law entrusts the Turkish Standards Institute to prepare all sorts of Turkish standards or authorize other entities to prepare them, to carry out any kind of scientific and technical researches on standards, to follow up similar international activities, to set up laboratories for research on standards, and also for the control of implementation of arbitrary standards, to carry out tests and inspections and prepare reports, to perform all activities to promote quality production in conformity with standards and to prepare the documents for these activities, to conduct research activities for metrology and calibration and to establish necessary laboratories.
In the General Assembly of CEN (European Committee for Standardisation) and CENELEC (European Committee for Electrotechnical Standardisation) in 1991 it has been decided that the standards institutions of countries which have concluded treaties towards economic integration with EU might become Affiliate Members of CEN/CENELEC. In this period the Turkish Standards Institution has applied to CEN/CENELEC for membership and acquired Affiliate Membership status. Affiliate Members assumes almost all the rights of full members, except for voting rights. Today CEN/CENELEC has 14 Affiliate Members including Turkey. As a result of its activities since 1991, the Turkish Standards Institution applied for full membership of the CEN/CELEC on 1 May 2001.
The Turkish Standard Institute actively participates in CEN/CENELEC activities although it only has Affiliate Member status. Up to now, the Institute has harmonized 6929 of 8107 CEN Standards, 3903 of 4395 CENELEC standards, 508 of 1794 ETSI standards. In other words, 81% of European Standards have been transposed into Turkish Legislation in the service of Turkish industry.
As the Turkish Standards Institute directly transposes European Standards, it also takes necessary actions for the active participation of representatives from Turkish Industry in the Technical Committee meetings where the standards are prepared. In this framework, regarding the prominence of the subject, TSE makes announcement to industry representatives, and the Chambers of Commerce and Industry via written and electronic form.
The Institute actively monitors 187 CEN and 44 CENELEC Technical Committees. These Technical Committees also prepare relevant standards regarding EU Directives. In this regard, as a response for the appeals to the Institute, contributions from industry have been received in respect of 74 CEN Standards of CEN Technical Committee and 9 CENELEC Standards of the CENELEC Technical Committee. In addition, 9 private sector representatives actively participate in 13 CEN Technical Committees.
The Quality System Certification Activities of TSE were accredited by the Turkish Accreditation Authority (TURKAK) and Dutch RVA, and the Metrology and Calibration Laboratory was accredited by TURKAK and German DKD. In addition, Laboratories operating under the Head of Unit of Laboratories were accredited by TURKAK.
Turkey has signed the UN/ECE (United Nations Economic Commission for Europe) Geneva Agreement Concerning The Adoption of Uniform Technical Prescriptions For Wheeled Vehicles, Equipment and Parts Which Can be Fitted and/or be Used on Wheeled Vehicles And The Conditions For Reciprocal Recognition of Approvals Granted on The Basis of These Prescriptions. The accession was ratified with Decision of Council of Ministers No. 94/5822 and under the scope of the Implementing Regulation Relating to Implementation of Technical Legislation Concerning Wheeled Vehicles, Equipment and Parts which Can be Fitted and/or be Used on Wheeled Vehicles which was published in the Official Gazette No. 22874, on 11 January 1997. The Ministry of Industry and Trade has became the approval authority and up to now, has adopted 102 UN/ECE Regulations and 91 EU Directives in the field of motor vehicles. The Ministry has appointed the TSE as the technical service for this legislation. In this regard, to constitute a basis for granting type approval, a total of 389 reports on 13 Regulations, and 458 reports on 31 Directives were prepared. During the period starting from the first Accession Partnership, 69 reports on 13 Regulations and 138 reports on 31 Directives were prepared.
Conformity checks on imports are carried out according to the Communiqué No. 2003/1 on Standardisation in Foreign Trade, published by the Undersecretariat for Foreign Trade in the Official Gazette No. 24976, on 27 December 2002.
Furthermore, in line with the provisions of Communiqué No. 2003/1, the certificates and marks issued (CE mark, e mark, etc) for products that have entered into free movement within the European Community and certified according to the EC legislation, are checked by the Institute. Within the scope of these checks, a conformity certificate is directly issued if the declaration of conformity and technical file for CE marked products and type approval certificate and conformity report for e marked products are submitted to the TSE before importation. In addition, the TSE Certification Centre and Electricity Laboratory is in the IEC/CB System which gives the mutual recognition of conformity certificates in the electrotechnical sector in the international area. The TSE is also a party to the CENELEC Certification Agreement (CCA), the Agreement on Certification of Cables and Cords (HAR), and KEY MARK Agreements within the structure of European Union Members. For these organisations, certificates and reports issued by the member certification bodies are mutually recognised.

PRIORITY 11. Public Procurement
1- Priority Description
Law No 4734 on Public Procurement and Law No 4735 on Public Procurement Contracts were published in the Official Gazette No 24648 on 22 January 2002 and both Laws entered into force on 1 January 2003. The Law No. 4761 Concerning Amendments of Some Laws amended some provisions of Public Procurement Law and was published on 22 June 2002 in the Official Gazette No. 24793. With these legislative adjustments harmonization with the EU acquis has been realised to a great extent.

PRIORITY 1.12 Non-Harmonized Area (Treaty Establishing European Community - Articles 28-30)
1- Priority Description
Turkey, through the candidacy perspective, has launched studies on quantity restrictions and measures having equivalent effect on trade in the context of harmonization with the provisions of Articles 28-30 of the Treaty Establishing the EC. For this purpose, the necessary contacts with related institutions have already been established. However, Turkey’s timetable for the implementation of measures regarding sectors included both in the harmonized area and non harmonized area but not subject to common arrangements, depends on the result of the discussions that will take place with the EU authorities. It was agreed to organise a technical meeting with the relevant European Commission services within the year 2003. Turkey, taking into consideration Association Council Decision No: 1/95, and in line with the reciprocity principle, will fulfil its obligations according the timetable which will be decided at this meeting.

2- FREE MOVEMENT OF PERSONS
Since the publication of the Council Decision of 8 March 2001 on the Accession Partnership with the Republic of Turkey, no legislation aimed directly at harmonization with the EU legislation on the free movement of persons has been promulgated.
Although it does not correspond to specific EU legislation, Law No.4817 on the Work Permits of Foreigners, published in the Official Gazette No.25040 dated March 6, 2003, provided for the simplification of the legislation in this field by introducing a single authority for granting work permits. The said Law also repealed Law No: 2007 on “the Arts and Services Allocated for Turkish Citizens in Turkey”. Within this framework, the requirement to be a Turkish citizen is abolished for some professions, such as interpreters, guides, photographers, drivers and waiters.

II- MEASURES FOR HARMONISATION WITH THE EU LEGISLATION AND IMPLEMENTATION

PRIORITY 2.1. Mutual Recognition of Professional Qualifications
1- Priority Description
Although alignment with the legislation regarding mutual recognition of professional qualifications was envisaged as a medium term priority in the 2003 Accession Partnership, taking into account the ongoing negotiations with the EU on liberalisation of services and public procurement, the said legislation is now considered a short-term priority for Turkey.
In this respect, both sectoral and general system directives will be introduced into the Turkish legal system, and the necessary institutional structure required by the new system will be established.
In addition, the Commission’s Proposal for a Directive on the recognition of professional qualifications envisages the consolidation of existing arrangements under one piece of legislation by repealing Directives 77/452/EEC, 77/453/EEC, 78/686/EEC, 78/687/EEC, 78/1026/EEC, 78/1027/EEC, 80/154/EEC, 80/155/EEC, 85/384/EEC, 85/432/EEC, 85/433/EEC, 89/48/EEC, 92/51/EEC, 93/16/EEC and 99/42/EC. In order for the legislation to be more comprehensible, easily accessible by everyone, and smoothly applicable, it is envisaged to enforce a single piece of legislation in Turkey regarding professional qualifications. In this respect, a working group will be set up with the participation of the related public institutions under the coordination of the Secretariat General for EU Affairs.
In addition to professional qualifications, a detailed scrutiny of Turkish legislation has been initiated in order to identify the potential obstacles to the EC Treaty provisions related to the right of establishment and the freedom to provide services. Accordingly, taking into consideration the negotiations on liberalisation of services and the reciprocity principle, the provisions requiring “Turkish citizenship” under specific laws will be gradually abolished for EU citizens for some professions before membership, while for some others the reciprocity principle will continue to be applicable until the removal of this requirement after membership.
Moreover, studies concerning alignment with EU legislation in the fields of coordination of social security, right of residence, and free movement of workers are ongoing. Including the date of entry into force, finalization of the draft legislation corresponding to these areas, which are being prepared or will be prepared, is envisaged before membership, by taking into consideration the reciprocity principle and the negotiations with the EU on the liberalisation of services.
